Not all complications arising from surgery is due to some form of negligence. All medical procedures come with some kind or risks and there is always the potential for complications. Medical malpractice occurs when a doctor, nurse or any other medical staff act in a manner that does not uphold the accepted expectations for treatment. Whether that be misinformation, inappropriate conduct or poor surgical practise.

Before You Pursue a Law Suit

Consider following the advice:

Contact a medical malpractice lawyer as soon as possible. It is best to deal with the situation as quickly as possible. Also there are certain statues of limitations if you wait too long.

Consult with an attorney that has dealt with a number of malpractice law suites and has a good track record of winning. Make sure to have ready every and any papers relating to your case, the lawyer will want to review all your info before moving forward with the suit. It is also customary to meet with the accused physician in order to get both sides of the story and if possible to suggest a our of court settlement.

There is the possibility that despite the fact that the physician is at fault he or she may refuse to offer any form of compensation. At this point it is wise to file a claim with the management of the clinic or medical facility and then with the College of Physicians.
